Introduction
Compulsory Third Party (CTP) insurance in NSW applies to personal injury claims arising out of an accident involving fault in the use or operation of a motor vehicle and to “blameless” accidents. It also involves a Life Time Care & Support Scheme (LTCS).
Accidents occurring prior to December 2017 are subject to the Motor Accidents Compensation Act 1999 (NSW).
Accidents occurring on or after 1 December 2017 are subject to the Motor Accident Injuries Act 2017 (NSW) which has introduced a new statutory benefits regime based on the Workers Compensation scheme which precedes a fault based damages scheme for non ‘minor injuries’.
