What Expert Evidence

Experts are often required in family law matters to provide specific opinion over sensitive legal, psychological, medical and financial matters.

Experts may be required to provide psychological or medical assessments of children in cases of family violence, divorce or child abuse.

Some are required to provide independent assessments of parenting capability to determine whether parents suffering from mental illness, financial instability or substance abuse should be authorised to continue to take care of their children.

In cases of divorce or separation, experts are also required to assess the most just and equitable division of assets, future income and child support.

In cases of domestic violence, knowledge of support worker practices and procedures may also be necessary.

The overall cost of expert opinion depends on the services required. Some of the key factors that affect the cost of advice include:

  • The need for a view or inspection of a location
  • The quantity of documentary material to be reviewed
  • Whether there are reports of other experts to be reviewed and commented on in detail
  • Whether there is a need for conferences with the expert either in person or by telephone/Skype
